Terms of service

What the service is

Puesto PH provides software tools for sellers to collect preorders, review submitted payment screenshots, and coordinate pickup and delivery. We are a technology provider, not the seller, merchant of record, payment processor, or escrow. Contracts of sale are formed directly between buyers and sellers. We do not take custody of goods or funds and do not guarantee any transaction between a buyer and a seller.

Eligibility and accounts

You must be of legal age and capacity to enter contracts. You must provide accurate account information, keep it current, protect your credentials, and are responsible for activity under your account. We may require verification of your identity or business before or during use.

Seller representations

By operating a shop on Puesto PH, you represent and warrant that:

• you are legally allowed to sell the items you list, and they comply with Philippine law;
• you hold and maintain the registrations, permits, and licenses your business requires, including, where applicable, DTI or SEC registration, BIR registration, local business permits, and any product-specific licenses (for example, FDA authorization for food, cosmetics, or health products);
• you will comply with tax obligations, including issuing official receipts or invoices where required;
• your items, prices, claims, and images are accurate and not misleading, and you have the rights to any content and trademarks you upload;
• you will not list prohibited, counterfeit, unsafe, or illegal goods; and
• you will honor the consumer-protection rights of your buyers, including under the Consumer Act (RA 7394).

You are solely responsible for your items, prices, schedules, buyer communications, fulfillment, refunds, taxes, and compliance. Payment screenshots require your review; the service does not guarantee that a submitted image represents a completed or valid payment.

Buyer data and data protection

When buyers submit orders, you receive their personal information as the personal information controller for that data, and Puesto PH processes it on your behalf. You agree to handle buyer data only to fulfill and support orders, to protect it, to comply with the Data Privacy Act (RA 10173), and not to use it for unrelated marketing or to disclose it without a lawful basis. You must promptly help resolve any data-subject request or complaint relating to your buyers. Our handling of personal information is described in our Privacy Policy.

Plans and billing

Features and usage limits depend on the selected plan or preorder credit. Prices and plan boundaries shown at purchase apply to that transaction. Unless otherwise stated, recurring plans renew until canceled. Fees for the software are separate from the prices sellers charge their buyers.

Refunds and disputes between buyers and sellers

Because sales are between buyers and sellers, refunds, cancellations, and fulfillment disputes are handled by the seller under their stated policies and applicable consumer law. We may provide records to help resolve a dispute but are not a party to it and are not responsible for a seller’s or buyer’s conduct.

Acceptable use

You may not use the service for fraud, illegal goods or services, harmful or infringing content, harassment, unauthorized access, scraping, or disruption of the service or its users. You may not misrepresent payment status or use the platform to launder funds or evade the law.

Complaints and takedowns

To report a listing, shop, or content that is illegal, infringing, unsafe, or otherwise violates these terms, contact hello@puestoph.com with details and any supporting evidence. We may remove content, restrict or suspend shops, or disable accounts that we reasonably believe violate these terms or the law, and we will act on valid legal or rights-holder requests.

Suspension and termination

You may stop using the service and delete your account at any time from Settings. We may restrict, suspend, or terminate access when necessary to protect users or the service, to comply with law, or for breach of these terms. Some records may be retained after termination as described in our Privacy Policy.

Availability and liability

We work to keep the service reliable, but availability is not guaranteed. To the extent permitted by law, the service is provided “as available”, and Puesto PH is not liable for indirect or consequential loss, or for the acts, omissions, goods, or content of sellers or buyers. Nothing in these terms limits rights that cannot be limited under Philippine law.

Governing law

These terms are governed by the laws of the Republic of the Philippines. Disputes are subject to the proper courts of the Philippines, without prejudice to any mandatory consumer rights.
